REGISTRATION REQUIREMENTS: Proper registration is required in order to bid at the auction. All bidders must complete and sign a Bidder Registration Form including name, address, phone number, social security number, and a valid driver’s license. Bidders must also present a separate cashier’s check (or other certified funds) in the amount of $2,500 for each unit they intend to purchase. By registering, all bidders acknowledge having read and agree to be bound by the Auction Terms and Conditions of the auction and having received a copy of the Original Sale Certificate. Registration at the auction site will open at 6:00 p.m.  

PRE-REGISTRATION – Bidders are encouraged to pre-register for the auction completing a Bidder Pre-Registration Form during a published open house event or by contacting the Auction Office (cashier’s check not required to pre-register). Pre-registered bidders will by-pass the standard registration line at the auction event and will simply need to present I.D. and their cashier’s check to receive their bidder numbers.

DOWN PAYMENT: For each unit purchased, the successful bidder(s) shall be required to make a 10% down payment of the total purchase price at the auction site immediately following the close of bidding. Such deposit to be in the form of $2,500 cashier’s check (made out to yourself and endorsed over to Title Company) plus a personal or business check for the balance. Deposits are not refundable, per the Purchase Agreement.

CONTRACT SIGNING: At the close of bidding for each unit, the high bidder will immediately sign a Bid Acknowledgement Form, submit the cashier’s check and be escorted to the contract signing area where he or she shall execute a Purchase Agreement and pay the required down payment (see above). Bidders wishing to purchase multiple units may remain in the auction room to continue bidding on additional units after signing the Bid Acknowledgement Form and submitting the cashier’s check. A separate Purchase Agreement must be executed for each unit on which a bidder is the acknowledged high bidder. Condominium documents and the Auction Purchase Agreement are available to bidders prior to the auction and should be thoroughly reviewed before bidding. Note: Winning bidders at the auction will have the opportunity to verify the accuracy of the information entered into the documents before signing, but will not have time to review all document details.  Questions about these documents should be directed to the Auction Company or buyer’s attorney prior to the auction.

FINANCING: Financing is not a contingency of sale in this offering. Therefore, it is strongly recommended that potential bidders ensure in advance that they are able to obtain the necessary financing to close the transaction, if applicable.

CLOSING: Buyer(s) shall close on or before January 14th, 2011.  Possession will be delivered at closing. The purchase agreement stipulates closing cost responsibilities including taxes and Homes Association dues which will be prorated as of the closing date.

EVIDENCE OF TITLE: Seller shall furnish at seller’s expense an Owner’s Policy of Title Insurance in the amount of the total purchase price and shall execute a general warranty deed conveying the real estate to the buyer(s).

AGENCY: Cates Auction & Realty Co., Inc. and its representatives are Exclusive Agents of the Seller.

BUYER’S PREMIUM: A buyer’s premium of ten percent (10%) shall be added to the high bid and included in the total purchase price to be paid by the successful bidder(s).

BROKER PARTICIPATION: A commission of three percent (3%) of the high bid will be paid at closing to any properly licensed Broker who registers a successful buyer according to the appropriate Broker Participation Agreement and requirements. This form is available from the Auction Company and must be fully completed and returned no later than 48 hours prior to the auction.

PUBLISHED RESERVE AUCTION: Reserves published in the advertising represent the seller’s minimum acceptable bids for each of the units. The seller has agreed in advance to accept high bids at or above the published reserves from qualified bidders at the auction. Bids below published reserves may not be recognized by the Auctioneer. In the event the Auctioneer should decide to recognize a high bid below the published reserve, that unit will be sold subject to seller acceptance. No previously published coupons, offers or incentives will be considered with any auction bid.
