REGISTRATION REQUIREMENTS:

Proper registration is required in order to bid at the auction. All bidders must complete and sign a Bidder Registration Form including name, address, phone number, social security number, and a valid driver’s license. Bidders must also present a separate cashier’s check (or other certified funds) in the amount of $20,000. By registering, all bidders acknowledge having read and agree to be bound by the Auction Terms and Conditions of the auction and having received a copy of the Missouri Condo Resale Certificate. Registration at the auction site will open at 6:00 pm. 

DOWN PAYMENT:

The successful high bidder(s) shall be required to make a 10% down payment of the total purchase price at the auction site immediately following the close of bidding. Such deposit to be in the form of $20,000 cashier’s check (made out to yourself and endorsed over to Title Company) plus a personal or business check for the balance.

CONTRACT SIGNING:

At the close of bidding the high bidder shall execute a Purchase Agreement and pay the required down payment (see above). Condominium documents and the Auction Purchase Agreement are available to bidders in written and electronic form prior to the auction and should be thoroughly reviewed before bidding. Note: Winning bidder at the auction will have the opportunity to verify the accuracy of the information entered into the documents before signing, but will not have time to review all document details.  Questions about these documents should be directed to the Auction Company or buyer’s attorney prior to the auction.

FINANCING:

Financing is not a contingency of sale in this offering. Therefore, it is strongly recommended that potential bidders ensure in advance that they are able to obtain the necessary financing to close the transaction, if applicable.

CLOSING:

Buyer(s) shall close on or before January 17, 2011.  Possession will be delivered at closing. The purchase agreement stipulates closing cost responsibilities including 2011 taxes and Homes Association dues which will be prorated as of the closing date. Two months of Condominium Association fees are due at closing along with $90 set-up fee to Curry Management Company. Note: arrangements for parking and/or storage spaces are handled independently with the Condominium Association following closing.

EVIDENCE OF TITLE

Seller shall furnish at seller’s expense an Owner’s Policy of Title Insurance in the amount of the total purchase price and shall execute a general warranty deed conveying the real estate to the buyer(s).

BUYER’S PREMIUM:

A buyer’s premium of ten percent (10%) shall be added to the high bid and included in the total purchase price to be paid by the successful bidder(s).

BROKER PARTICIPATION:

A commission of three percent (3%) of the high bid will be paid at closing to any properly licensed Broker who registers a successful buyer according to the appropriate Broker Participation Agreement and requirements. This form is available from the Auction Company and must be fully completed and returned no later than 48 hours prior to the auction.
